Special Marriage Act, 1954 — overview
The Special Marriage Act is a central law that allows two consenting adults to marry legally regardless of caste, religion or nationality. Its biggest advantage is that neither partner has to change their religion. This makes it the most appropriate and secure legal route for inter-caste and inter-religion (love) marriages.
How it works, from notice to certificate
- Notice of intended marriage: Both partners file a notice with the marriage officer.
- 30-day notice period: A public notice is issued; if no valid objection is raised during this period, the process moves forward.
- Declaration & signing: The declaration is signed in the presence of 3 witnesses.
- Marriage certificate: The officer issues the official certificate, which is valid across India.
The 30-day notice period is legally mandatory. If you need to marry sooner, we can also suggest faster legal options such as an Arya Samaj ceremony followed by registration.
Documents required
- Identity proof for both partners (Aadhaar / passport / voter ID)
- Age proof (ladka 21+, ladki 18+)
- Address proof (important for the notice)
- Passport-size photographs
- 3 witnesses with ID proof
